Discriminating against a Scientologist in Germany is illegal, Federal Court said

Munich can not discriminate against a citizen and deny a grant for a pedelec (eBike) based on her “wanting to continue being a member of Scientology”. Therefore, Germany’s Federal Administrative Court [BVerwG.de], confirming a previous decision of the Bavarian Administrative Court, condemns the City for discriminating against a member of Scientology.

The applicant applied for a partial grant to purchase a pedelec (a specific type of electric bike) based on the “Electromobility Funding Guidelines” of Munich. In promoting a more environmentally sustainable way of transport within the city, Munich’s guidelines on electromobility foresaw that autonomous workers could get help to buy an electric bike, and thus set a program to partially fund the purchase of this type of transport if the person would meet certain requisites. One of the requisites was to submit a faith declaration that one would not be a Scientologist or attend Scientology courses, lectures, etc.

When applying for the grant, the German citizen who is an artist did not submit the “Declaration of Protection Concerning the Teachings of L. Ron Hubbard/Scientology” contained in the application form, as considered it was not a lawful requirement. And the court found that denying the subsidy based on that is discriminatory and unlawful interference in the freedom of belief and against the values and right to equal treatment.

DEMANDING DECLARATIONS ABOUT ONE’S BELIEF IS NOT A MATTER FOR THE LOCAL MUNICIPALITY

Munich must now subsidise the woman’s e-bike. “Since all other requirements for the subsidy are fulfilled, the defendant is obliged to grant the plaintiff” the subsidy, the Federal Administrative Court ruled.

According to a statement by Germany’s Federal Administrative Court, a “municipality may not make the granting of a financial subsidy with which environmental policy objectives are pursued subject to the condition that the applicants submit a declaration distancing themselves from the Scientology organization.” This was decided today by the Federal Administrative Court in Leipzig.

The defendant rejected the application with reference to the missing declaration. The Administrative Court dismissed the lawsuit. The Higher Administrative Court obliged the defendant to grant the plaintiff a funding commitment in accordance with her application.

The judgement

The Federal Administrative Court confirmed the appeal judgement.

“The defendant must not make the funding dependent on the submission of the Declaration of Protection. Demanding declarations about one’s belief is not a matter for the local municipality within the meaning of the first sentence of Article 28 (2) of the Basic Law, so that the defendant already lacks competence”.

If such a declaration is demanded and its refusal entails exclusion from funding, this purposefully interferes with the freedom of religion and belief guaranteed by Article 4 (1) and (2) of the Basic Law. The interference is already unconstitutional for lack of a legal basis.

Finally, the defendant’s [City of Munich] approach violates the general principle of equal treatment (Article 3 (1) of the Basic Law). It constitutes an inadmissible differentiation because it does not delimit the group of persons entitled to financial subsidy appropriately, but according to criteria that have no connection with the objective of the financial subsidy. Since all other requirements for funding are fulfilled, the defendant is obliged to grant the plaintiff a corresponding commitment.

International exposure of Germany discriminating against Scientology

Scientologists have been for several years engaging in defending their rights at courts in Germany and also advocating at the OSCE and the UN for their religious freedom to be respected by German authorities.

Last September 2020, Scientology had requested the UN to launch an investigation on Germany for violating religious freedom, and in fact, the Special Rapporteur on FORB Ahmed Shaheed had previously written a letter to the German government inquiring about their practices of discriminating against Scientology. While the Scientologists still have some work to do to get their rights respected by German officials, it seems, said Ivan Arjona to The European Times, that “persistence in court, international exposure and above all, proper abidance to the law and justice system, is paying off to make Germany stop discriminating against Scientology”.

In this regard, the resolution just adopted by the 49th Session of UN Human Rights Council, “A/HRC/49/L.5 Combating intolerance, negative stereotyping and stigmatization of, and discrimination, incitement to violence and violence against, persons based on religion or belief” calls on States (and this includes Germany):

  1. Calls upon all States:
    (a) To take effective measures to ensure that public functionaries, in the conduct of their public duties, do not discriminate against individuals on the basis of religion or belief;
    (b) To foster religious freedom and pluralism by promoting the ability of members of all religious communities to manifest their religion and to contribute openly and on an equal footing to society;
    (c) To encourage the representation and meaningful participation of individuals, irrespective of their religion, in all sectors of society;
    (d) To make a strong effort to counter religious profiling, which is understood to be the invidious use of religion as a criterion in conducting questionings, searches and other law enforcement investigative procedures;

Will some of the German authorities continue discriminating against Scientology and others despite the above? This is an open question to be seen.

November 15th, MEP Roberta Metsola, Vice President of the European Parliament, held the seminar “Article 17 dialogue on the Conference on the Future of Europe

BRUSSELS, BELGIUM, Last November 15th, 2021, MEP Roberta Metsola, Vice President of the European Parliament, held the seminar “Article 17 dialogue on the Conference on the Future of Europe”, which took place in the Parliament and also online.

Representatives of the COMECE, CEC, CROCEU, Humanists, EGALE, Jewish community, Muslims, and others were at the panel. Other movements like the Church of Scientology, were able to take the floor through written questions, video calls, and others.

MEP Metsola said at the introductory presentation that: “Why have we organized this seminar? First of all, today’s dialogue seminar is about the Conference on the Future of Europe. It’s something that has dominated our debates here and we could not let time pass without engaging with all of you, in terms of what your thoughts in this process are. […] So after all the shocks that we have experienced over the past few years, our future is something that we have been contemplating a lot recently. Various crises such as the economic and migration crisis, Brexit, and this pandemic as well as more long-term issues such as climate change, have really made us reassess where we are and where we want to be.”

Metsola also stressed that: “Change can be daunting but it is often times necessary circumstances change around us and we need to change along with them so that we can respond to them appropriately or else we realize the error of our ways and correct our behavior when we realize the consequences of our actions… Of course, that change can also be a very positive thing, not just a necessity, it is an opportunity to make our lives and our surroundings better than they are now and yes, the future is uncertain but it is not completely out of control, it is shaped by its past and our future is shaped by our actions today.”

In regards to the seminar, the VicePresident explained that “the aim is to debate how the EU should develop in the future, identify where it is rising to current challenges and strengthen those areas that need reform. One of the most valuable aspects has been its inclusion of an engagement with citizens and in order for change to be successful to go with the team we all need to take ownership of this conference and share a sense of purpose because the EU belongs to all of us Europeans.”

In “this dialogue seminar in which I would like you to be” said Metsola, “as open, even critical, as possible[…] I would really like us to listen to whatever is said very carefully…”.

After the interventions of the different faiths and philosophical organizations that were invited to the panel, the Co-Chair of the European Parliaments Intergroup on Freedom of Religion or Belief and Religious Religious Tolerance, Mr. Peter Van Dalen, posed the following question: “we focus mainly on the outside EU world since we focus on the work of the EU External Action Service and that is the world beyond Europe so, madam chairman, that brings me to the question to the panel ‘how do you see the freedom of religion or belief and non-belief within the EU? … could you indicate to us what do you see as threats and what do you see as opportunities in the field of freedom of religion or belief and non-belief within the EU?

Another contribution was the one of Ivan Arjona-Pelado, President of the European Office of the Church of Scientology for Public Affairs and Human Rights, which was read by the EP Vice-President Roberta Metsola, as it has been reported by The European Times:

“there seems to be no mechanism within the EU institutions to call its own member states to order when state laws and practices discriminate people based on their religion. They discriminate Muslims, Hindus, Scientologists and others. No state should be allowed, as Germany does, to request citizens to resign from a specific religion, in order to participate in the institutions or even as a gardens architect in the city hall.”, .

¿Quién soy?

Iván Arjona Pelado. Nacido en Tarragona en 1980. Se crió hasta los 17 años en un barrio de la periferia de Tarragona, llamado Bonavista.

Asistió al entonces llamado Colegio Público Bonavista desde 1986 hasta 1994, cuando se graduó de le E.G.B.

Desde 1988 a 1992 fue miembro del equipo de atletismo de su colegio, siendo los últimos dos años del Club Gimnastic de Tarragona con quien participó en muchos campeonates a nivel provincial.

Del 93 al 94, fue base del equipo de Baloncesto del CP Bonavista, donde fue premiado como máximo encestador de su equipo en la liga.

Sus dos últimos años de EGB (1993-94), fue uno de los dos representantes de los Alumnos, en el Consejo Escolar.

Estudio el BUP en dos institutos distintos IB Camp Clar (Camp Clar, Tarragona) y el último año en el Instituto Mila Fontanals (Barcelona).

Durante su tiempo en el IB Camp Clar, era jugador de Baloncesto del ADT Torreforta donde jugaba como base/alero, actividad que compaginaba con la de Árbitro de Fútbol del Col.legi d'Àrbitres de Tarragona, arbitrando encuentros desde la categoria de alevín hasta 3ª Reginonal como árbitro principial y hasta categoría Preferente (en Catalunya) como Juez de Línea, actividad que continuó en 1997 en Barcelona.


Conoció por primera vez la religión de Scientology en 1997, cuando rápidamente decidió dedicar su vida a conseguir las metas de esta religón nacida en los años 50. Se formó en la iglesia de Madrid, Copenague (donde sirvió en en un cargo a nivel Europeo), y Los Angeles (donde se encuentra la Iglesia de Scientology Internacional). Ha servido a la religión de Scientology en diferentes países como Dinamarca. Francia, Bélgica y en su país natal España, siempre realizando tareas ejecutivas y administrativas.

Desde su última asignación, cuando llegó de vuelta a España en el 2005, el Sr. Arjona ha participado en numeros actos como orador invitado, como conocedor de la Libertad Religiosa y los Derechos Humanos, impartiendo canferencias en universidades como la Facultad de Derecho de la Universidad Alcalá de Henares (en la Comunidad de Madrid), la Facultad de Derecho de Universidad Autónoma de Barcelona, la Facultad de Derechos de la Universidad de A Coruña (en el Master de la Unión Europea) y conferencias en las que ha compartido mesa con profesores expertos en Libertad Religiosa, Derecho Penal, Lideres Relgiosos de diversas confesiones, así comoo con expertos en Derechos Humanos, y funcionarios públicos a nivel local, regional y nacional. También ha sido reconocido por el apoyo dado a las actividades de la Comunidad Negra en España y reivindicaciones de sus derechos como ciudadanos.

Además, desde el año 2007, conocedor del importante papel que juegan los medios de comunicación en la creación de un mundo más plural y tolerante, se ha hecho cargo de la representación pública de la religión de Scientology, siendo entrevistado en numerosas ocasiones por los medios de comuniación en prensa, radio, televisión e internet.

Tomó el cargo de Presidente el pasado año 2007.
